CITY OF LINO LAKES <br />ORDINANCE NO. 16-03 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF LINO <br />LAKES BY REZONING THE LAND WITHIN THE HALEY MANOR PLAT <br />FROM R RURAL TO R-1 SINGLE FAMILY RESIDENTIAL <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1: Findings <br />The City Council makes the following findings regarding the application for rezoning the <br />property described below, based on the factors listed in Section 2, Subd.1.E and 1.F. of the Lino <br />Lakes zoning ordinance: <br />1. The proposed action has been considered in relation to the specific policies and provisions of <br />and the official City Comprehensive Plan. Resolution 03-119 approves amending the <br />comprehensive plan to change the land use category of the Haley Manor land to Low Density <br />Sewered Residential and acquire more MUSA reserve for the project. The ten new <br />residential lots being created by Haley Manor falls within the annual number of new housing <br />units (147) for 2003, in compliance with the Growth Management Policy, Ordinance 01-03. <br />2. The proposed use is or will be compatible with present and future land uses of the area. <br />Bluebill Ponds to the north and Highland Meadows West to the east both are zoned R-1. The <br />R-1 zone allows lots of 10,800 sf, which would accommodate the Haley Manor lots, and <br />would be consistent with adjacent urbanized development. <br />3. Upon compliance with the conditions of approval set forth in Resolution 03-119 and <br />Resolution 03-120, the proposed use will conform with performance standards contained in <br />the zoning ordinance and other requirements. <br />4. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. Utilities are currently available to the site, and <br />compliance with Resolution 03-119 and Resolution 03-120 will ensure proper utility service. <br />5. Traffic generation by the proposed use is within capabilities of streets serving the property in <br />conjunction with the public improvements proposed. The addition of 10 single family homes <br />will not overburden the roadway system. Lois Lane has outlets to the east and west and <br />Country Lane connects to 77th St. to the south. <br />6. A public hearing was held before the Planning & Zoning Board on July 9, 2003. <br />
