Subd. 3 . Amendments and Rezoninas. In accordance with the <br /> provisions of Minnesota statutes, the city council may from time to <br /> time amend the zoning ordinance or zoning district map (rezoning) . *� <br /> Amendments to the text may be initiated by council, design review <br /> board, property owner, or resident. <br /> The procedure for an amendment to the zoning ordinance or <br /> zoning district map (rezone) shall be as follows: <br /> (1) Persons wishing to initiate an amendment shall fill out <br /> a "Zoning Form" and be accompanied by a fee as required <br /> in Section 9 of this ordinance to be used for the costs <br /> of processing the application. The Zoning Form shall be <br /> filed with the city planner. <br /> (2) Property owners or occupants within three hundred fifty <br /> (35) feet of any property of five acres or less proposed <br /> for zoning district amendment (rezoning) shall be <br /> notified in writing, although failure by any property <br /> owner to receive such notification shall not invalidate <br /> the proceedings . Notification shall be by mail. <br /> (3) All requests for amendments shall be referred to the <br /> design review board for review and recommendation to city <br /> council. <br /> (4) Site and building plans consistent with the requirements <br /> established in Section 5, Subd. 4 shall be provided prior <br /> to design review board review. This requirement may be <br /> waived if rezoning can be accommodated without review of <br /> a specific proposal. <br /> (5) Upon review of the application, the design review board <br /> shall make a report and recommendation to the city <br /> council. <br /> (6) A public hearing on the rezoning application shall be <br /> held by the design review board or council. <br /> (7) Notice of the purpose, time and place of such public <br /> hearing shall be published in the official newspaper of <br /> the city and mailed to the appropriate property owners at <br /> least ten days prior to the public hearing. <br /> (8) The city council must take action on the application <br /> within sixty (60) days following referral by the design <br /> review board.
