,.-., Subd. 5. Conditional Use Permits. (1) General Statement. Certain uses, while generally not suitable in a particular zoning district, may under some circumstances be suitable. When such circumstances exist, a conditional use permit may be granted. Conditions may be applied to issuance of the permit and an annual review of the permit shall be required. The permit shall be granted for a particular use and not for a particular person or firm. Conditional use permits may be granted in accordance with this subdivision for any use or purpose for which such permits are required or permitted by this ordinance or as listed as a conditional use for the zoning districts provided in Section 6 of this ordinance. In granting a conditional use permit, the city council shall consider the advise and recommendations of the design review board and the effect of the proposed use upon the health, safety, convenience, and general welfare of occupants of surrounding lands. (2) Applications. Applications for site and building plan review shall be filed with the city planner and shall be accompanied by: (3) Standards. The design review board shall recommend a conditional use permit and the council shall order the issuance of such permit only if it finds that such use at the proposed location: (A) Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. (B) Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the city and this ordinance. (C) Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area.
