shall be held by the design review board or the <br /> city council. <br /> (G) At least 10 days prior to the public hearing; <br /> notice of the purpose, time and place of such <br /> public hearing shall be published in the official <br /> newspaper of the city and mailed to the property <br /> owners within 350 feet of the property in question. <br /> Failure of any property owner to receive the mailed <br /> notification shall not invalidate the proceedings. <br /> (H) The city council must take action on the <br /> application within 60 days after receiving the <br /> report of the design review board. If it grants <br /> the conditional use permit, the city council may <br /> impose conditions it considers necessary to protect <br /> the public health, safety and welfare, and such <br /> conditions may include a time limit for the use to <br /> exist or operate. <br /> (I) An amended conditional use permit application and <br /> requests for changes in conditions shall be <br /> administered in a manner similar to that required <br /> for a conditional use permit. <br /> (J) No application for a conditional use permit shall <br /> be resubmitted for a period of twelve (12) months <br /> from the date of said order of denial unless all <br /> reasons for denial as outlined by the city council <br /> have been satisfied. <br /> (K) Conditional use permits - filing. Following <br /> approval of the conditional use permit a certified <br /> copy thereof including a legal description of the <br /> property shall be filed with the county recorder <br /> and/or registrar of title. <br /> Subd. 6. Certificate of Occupancy. No person may change the <br /> use of any land except for construction of essential services and <br /> transmission lines or occupy or utilize a new structurally altered <br /> building (except single-family detached dwellings or their <br /> accessory buildings or private garages in any district) or change <br /> the use of any building after the effective date of this ordinance <br /> unless he has first obtained a certificate of occupancy. <br /> Application for a certificate of occupancy for a new building <br /> or for an existing building which has been so altered or the reuse <br /> of any land may be filed with the Building Official any time after <br /> City of Lino Lakes Zoning Ordinance <br /> ADOPTED 7/13/92 <br /> ter"\ <br /> 61 <br />
