<br />ORDINANCE NO. 07.84
<br />An Ordinance amending the Lino Lakes Home
<br />Rule Charter by allowing a more efficient process
<br />for Improvement projects which are 100 percent
<br />(100%) petitioned and establishing a procedure
<br />when a proposed contract exceeds the estimated
<br />cost by more than ten (10%) percent.
<br />Section 1. Chapter 8, Section 9.08, Subdivision'2
<br />of the Lino Lakes Home Rule Charter is amended to
<br />read as follows: •
<br />Regardless of the provisions In subdivision 1 of
<br />this section, when less than 100 (100%) percent of
<br />the estimated cost of the proposed improvement is
<br />to be paid for by special assessments, or connect
<br />lion charges, the Council shall within 120 days after
<br />the conclusion of the public •hearing, submit the
<br />proposed local improvement and its assessment
<br />formula to the voters o1 the City. If no election is
<br />scheduled during such 120 day period, the Council
<br />shall schedule.a special election by which said im-
<br />provement and its associated assessment formula
<br />can be submitted to the City's voters. If a majority. of
<br />those voting on said improvement and Its
<br />associated assessment formula are opposed, the
<br />Council shall not proceed with the • local im-
<br />provement as proposed.
<br />Section 8. Chapter8, Section 8.04, Subdivision 3
<br />of the Lino Lakes Home Rule Charter is amended to
<br />read as follows:
<br />Section 8.04, Subdivision 3. When a proposed Im-
<br />provement is allowed under the foregoing sub-
<br />division, and the public record of the proposed im-
<br />provement contains all of the evidence on which the
<br />Council shall base their decision, the Council may
<br />by resolution, at any time between sixty (60) days
<br />and one (1) year after the conclusion of the public
<br />hearing, proceed,on the improvement. If after bids
<br />are received on the project the proposed contract
<br />exceeds the estimated cost of the engineer stated at
<br />the public hearing held under Subdivision 1 by more
<br />than ten (10%) percent, the City Council may not
<br />award the contract for the proposed improvement,
<br />but may re -bid the project for one time only.
<br />Section 3. Chapter 8 of the Lino Lakes Home Rule
<br />Charter be amended to add the following Section.
<br />Section 8.06. When under the provisions of Sec-
<br />tion 8.04, Subdivision 1, an improvement is
<br />petitioned for by 100 percent of the benefitted
<br />property owners, such property owners may after (a)
<br />the mailing of notice of a public hearing and public
<br />hearing, may petition to waive fifty (50) of the sixty
<br />(60) day waiting period. After such petition, the City
<br />Council may immediately order the . proposed
<br />project.
<br />Section 4. This Ordinance shall be effective
<br />ninety (90) days after passage and publication as
<br />provided by law.

<br />Eugene D. Johnson being duly sworn on oath says he is and during all times here-
<br />in stated has been the publisher and printer of the newspaper known as The Quad
<br />Community Press and has full knowledge of the facts herein stated as follows: (1)
<br />Said newspaper is printed in the English language in newspaper format and in
<br />column and sheet form equivalent in printed space to at least 900 square inches.
<br />(2) Said newspaper is a weekly and is distributed at least once each week. (3) Said
<br />newspaper, in at least half of its issues each year, has not more than 75 percent of
<br />its printed space comprised of advertising material and paid legal notices; and in
<br />all of its issues each year has 50 percent of its news columns devoted to news of
<br />local interest to the community which it purports to serve, but not more than 25
<br />percent of its total nonadvertising column inches in any issues wholly duplicates
<br />any other publication unless the duplicated material is from recognized general
<br />news services. (4) Said newspaper is circulated in and near the municipality which
<br />it purports to serve and has at least 500 copies regularly delivered to paying sub-
<br />scribers and has entry as second-class matter in its local post office, or has at
<br />least 500 copies regularly distributed without charge to local residents. (5) Said
<br />newspaper purports to serve the cities of Centerville, Circle Pines, Lexington,
<br />Lino Lakes, Blaine and Mounds View of Minnesota in the Counties of Ramsey
<br />and Anoka and has its known office of issue in the City of White Bear Lake in
<br />said county, established and open during its regular business hours for the gath-
<br />ering of news, sale of advertisements and sale of subscriptions and maintained by
<br />Eugene D. Johnson or persons in its employ and subject to his direction and con-
<br />trol during all such regular business hours and at which said newspaper is print-
<br />ed. (6) Said newspaper files a copy of each issue immediately with the State
<br />Historical Society. (7) Said newspaper is made available at single or subscription
<br />prices to any person, corporation, partnership or other unincorporated associa-
<br />tion requesting the newspaper and making the applicable payment, or is distrib-
<br />uted without charge to local residents. (8) Said newspaper has complied with all
<br />the foregoing conditions for at least one year preceding the day or dates of publi-
<br />cation mentioned below. (9) Said newspaper annually publishes and submits to
<br />the Secretary of State a sworn United States Post Office second-class statement
<br />of ownership and circulation or annually publishes and submits a statement of
<br />ownership and circulation verified by a recognized independent circulation audit-
<br />ing agency.

<br />was printed and published therein in the English language, once each week, for

<br />to and including the the day of
<br />19 and that the following is a printed copy of the lower case alphabet from A
