• <br />• <br />The commercial site fulfills the comprehensive plan's design to have the intersection <br />become a commercial area and is compatible with the commercial development on <br />the north side of Birch St. The commercial building provides commercial services to <br />the existing and newly proposed residential development. <br />c. The proposed development application conforms to performance standards herein and <br />other applicable City Codes. The commercial site complies with zoning <br />requirements. <br />d. Traffic generated by a proposed development application is within the capabilities of <br />the City. The roadways will be improved in such a way that they will accommodate <br />the proposed development and correct an existing undesirable situation. <br />e. The proposed development shall be served with adequate and safe water supply. City <br />water is available to the project.. <br />f. The proposed development shall be served with an adequate and safe sanitary sewer <br />system. City sanitary sewer service is available to the project. <br />g. <br />The proposed development shall not result in the premature expenditures of City <br />funds on capital improvements necessary to accommodate the proposed development. <br />The City will not be responsible for any premature capital improvements. <br />h. Will not involve uses, activities, processes, materials, equipment and conditions of <br />operation that will be detrimental to any persons, property, or the general welfare <br />because of excessive production of traffic, noise, smoke, fumes, glare, or odors. No <br />such uses will occur on the commercial site. <br />i. Will not result in the destruction, loss, or damage of a natural, scenic or historic <br />feature of major importance. The site has been part of a farm for many years. No <br />significant features are on the site. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby <br />approves a conditional use permit for a commercial daycare facility with the following <br />conditions: <br />1. All requirements of the Minnesota Department of Health and Human Services, as <br />may be amended, shall be satisfactorily met and the structure and operation shall <br />be licensed accordingly. <br />2. Screening is provided along all shared property lines. The landscaping plan shall <br />have additional screening prior to final platting of the site. <br />3. Adequate off-street parking is provided in a location separated from any outdoor <br />play area(s), as indicated in the approved plans: parking stalls are on the north <br />side of the building and the play area is on the south side. <br />Resolution 03-143, page 2 <br />
