Condominium Association. The community association that administers and <br />maintains the common property and common elements of a condominium. <br />Construction. The erection, alteration or extension of a structure. <br />Cooperative Housing. A multiple family dwelling owned and maintained by the <br />residents and subject to the provisions of Minnesota Statutes 290.09 and 290.13. <br />The entire structure and real property is under common ownership as contrasted <br />to a condominium dwelling where individual units are under separate individual <br />occupant ownership. <br />Critical Area. An area with one or more of the following characteristics: (1) <br />slopes in excess of twenty (20) percent; (2) floodplain; (3) soils classified as <br />having a high water table; (4) soils classified as highly erodible, subject to <br />erosion; (5) land incapable of meeting percolation requirements; (6) land formerly <br />used for landfill operations or hazardous industrial use; (7) fault areas; (8) stream <br />corridors; (9) estuaries; (10) mature strands of native vegetation; (11) aquifer <br />recharge and discharge areas. <br />Critical Root Zone (CRZ). An imaginary circle surrounding the tree trunk with a <br />radius distance of one (1) foot per one (1) inch of tree diameter, e.g., a twenty <br />(20) inch diameter tree has a CRZ with a radius of twenty (20) feet. <br />Cul-de-sac. (See Street) <br />Day Care Facility. Any facility licensed by the State Department of Public <br />Welfare, public or private, which for gain or otherwise regularly provides one or <br />more persons with care, training, supervision, habilitation, rehabilitation or <br />developmental guidance on a regular basis, for periods of less than twenty-four <br />(24) hours per day, in a place other than the person's own home. Day care <br />facilities include, but are not limited to, family day care homes, group family day <br />care homes, day care centers, day nurseries, nursery schools, daytime activity <br />centers, day treatment programs and day services, as defined by Minnesota <br />State Statutes, Section 245.782.5. <br />Deck. Horizontal, unenclosed platform with or without attached railings, seats, <br />trellises, or other features, attached or functionally related to a principal use or <br />site and at any point extending above grade. <br />Density. The number of families, individuals, dwelling units, or housing <br />structures per unit of land. In this Ordinance, net density shall mean number of <br />dwelling units per acre of buildable land. Gross density shall mean number of <br />units per acre of the total subject property. <br />Detached Garage.
