Floodplain <br />The current 1982 FEMA FIRM indicates Zone A floodplain potentially affecting Lots 4- <br />6, Block 4, NorthPointe 3rd Addition. The applicant has applied for and received a <br />Conditional Letter of Map Amendment; however, a Letter of Map Revision shall be <br />required by the City prior to any building permits being issued on these lots. <br />Development Agreement <br />A Development Agreement shall be drafted by the City, executed by the City and the <br />developer and recorded by the developer. <br />Title Commitment <br />The City Attorney reviewed the title commitment and final plat and notes the <br />commitment must be updated and consent of the mortgages shall be obtained. <br />Stormwater Maintenance Agreement <br />A Maintenance Agreement for Stormwater Management Facilities was approved by the <br />City Council on August 11, 2014 with Resolution No. 14-87 for the entire NorthPointe <br />development. <br />RECOMMENDATION <br />Staff recommends approval of the NorthPointe 3rd Addition final plat subject to the <br />following conditions: <br />1. All comments from City Engineer letter dated August 4, 2015 shall be addressed. <br />2. All comments from MNDOT letter dated July 20, 2015 shall be addressed. <br />3. A Development Agreement shall be drafted by the City, executed by the City and <br />the developer and recorded by the developer. <br />4. The Phasing Plan shall be revised to reflect changes from the original plan. <br />5. A south bound by-pass lane on 201h Avenue/CSAH 54 at Red Oak Lane shall be <br />constructed. <br />a. The applicant shall coordinate with Anoka County on design and <br />approval. <br />b. The approved construction plans shall be submitted to the City. <br />6. A FEMA Letter of Map Revision shall be required by the City prior to any <br />building permits being issued on lots affected by the floodplain. <br />7. Title Commitment: <br />a. Shall be updated <br />b. Consent of the Mortgagees shall be obtained <br />2 <br />
