AGENDA ITEM NO. 6A <br />STAFF ORIGINATOR: Rick DeGardner, Public Services Director <br />COUNCIL MEETING DATE: July 9, 2001 <br />TOPIC: Consideration of Resolution 01-90, Authorizing <br />Condemnation at 6993 & 6998 Black Duck Drive For <br />Public Trail <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />For the past several years, the City of Lino Lakes has been attempting to place a public <br />trail at the north end of Reshanau Lake. At the April 9, 2001 City Council meeting, the <br />City Council approved the purchase agreements to acquire the necessary land located <br />at 6993 Black Duck Drive and 6998 Black Duck Drive. <br />In June, 2001 staff was informed by one of the property owners that the mortgage <br />lenders of his property require a complex, time consuming, and expensive process to <br />authorize the sale of the land to the City. Subsequently, both property owners are <br />requesting the City initiate a "friendly" condemnation process to acquire the land <br />described in the purchase agreements. <br />Therefore, staff is recommending the City Council direct the city attorney to begin <br />condemnation proceedings to acquire the necessary land at 6993 Black Duck Drive and <br />6998 Black Duck Drive as previously agreed with the property owners. All components <br />of the purchase agreements will remain in effect. <br />OPTIONS: <br />1. Approve Resolution 01-90. <br />2. Do not approve Resolution 01-90. <br />3.
