AGENDA ITEM 7D STAFF ORIGINATOR: Jim Studenski, City Engineer COUNCIL MEETING DATE: June 10, 2002 TOPIC: Resolution No. 02-54, Accepting Petition and Calling for Public Hearing on Improvements, Marshan Lane Utility Improvements. VOTE REQUIRED: Simple Majority BACKGROUND: The City received a petition on September 25, 2001, from residents and property owners on Marshan Lane, east of Lake Drive, for preparation of a feasibility report on sanitary sewer and water service. City Council received the petition and ordered the feasibility report on October 8, 2001. On January 14, 2002, the City Council received the feasibility report. A copy of the report was then sent out to the residents for their determination as to whether or not they want to continue with the Public Improvement process. The City received a Petition from 4 of the 10 residents on May 13, 2002, requesting installation of sanitary sewer and water utilities. The petition meets City Charter requirements that at least 25% of the benefited property owners have signed the petition for the City to proceed with the public hearing. The next step in the process would be to accept the Petition and hold a Public Hearing on the proposed improvements. OPTIONS: 1. Return to staff for further review. 2. Adopt Resolution No. 02-54, Receive Petition and Calling for a Public Hearing for the Marshan Lane Utility Improvements. RECOMMENDATION: Option No. 2 - Staff recommends that Resolution No. 02-54 be adopted.
