CITY OF LINO LAKES RESOLUTION NO. 02-167 RESOLUTION AUTHORIZING THE CERTIFICATION OF DELINQUENT WATER AND SEWER UTILITY CHARGES FOR COLLECTION WITH THE 2002 PROPERTY TAXES PAYABLE IN 2003 WHEREAS, the utility charges for Kelley Kimball, 7636 Appaloosa Lane, PIN 07-31-22- 43-0056, were removed from a list of properties having delinquent water and sewer charges that were certified to the Anoka County Auditor for collection with the 2001 property taxes, payable in 2002, pursuant to an investigation of disputed water consumption, and WHEREAS, City staff worked with Mr. Kimball to resolve the disputed consumption claim, and, WHEREAS, during the time elapsed in working through the dispute $591.88 in late penalty fees accrued to Mr. Kimball's account, and, WHEREAS, the City Council has agreed to waive such penalty fees in settlement of Mr. Kimball's dispute claim, and, WHEREAS, following the waiver of such late fees there remains a substantial delinquent balance on Mr. Kimball's utility account. NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: 1) Late penalty fees of 591.88 are hereby waived, reducing the delinquent amount from $2,218.19 to $1,626.31. 2) The delinquent amount of $1,626.31, plus a $30.00 processing fee, will be certified to the Anoka County Auditor, at an interest rate of 8% per annum, for collection with 2002 property taxes, collectible in 2003, if not paid in full by November 25, 2002.
