AGENDA ITEM 1A(iii) <br />STAFF ORIGINATOR Al Rolek <br />MEETING DATE November 12, 2002 <br />TOPIC Resolution No. 02-167 Authorizing The Certification Of Delinquent <br />Water And Sewer Utility Charges For Collection With The 2002 <br />Property Taxes Payable In 2003 — Kelley Kimball, 7636 <br />Appaloosa Lane <br />VOTE REQUIRED <br />BACKGROUND <br />Simple Majority (3/5) <br />Mr. Kelley Kimball met with the City Council at its work session on November 6 to negotiate a <br />solution to his water consumption dispute. After a lengthy discussion, the consensus of the <br />Council was that, while the consumption measured by Mr. Kimball's meter appeared to be <br />accurate, penalty fees incurred during the period of the dispute should be waived. <br />Staff has prepared Resolution No. 02-167 that waives $591.88 in penalty fees incurred to Mr. <br />Kimball's account over the last year and provides for the certification of the remaining delinquent <br />balance of $1,626.31 if not paid by November 25. The resolution has been forwarded to Mr. <br />Kimball who has concurred with the language. <br />Staffs recommendation is for approval of Resolution 02-167. <br />OPTIONS <br />1) Adopt Resolution No. 02-167. <br />2) Return to staff for further review. <br />3) Do not adopted Resolution No. 02-167. <br />RECOMMENDATION <br />Option 1. <br />
