CITY COUNCIL <br />AGENDA ITEM 3A <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />MEETING DATE: June 8, 2015 <br />TOPIC: Consider 2nd Reading and Passage of Ordinance No. 02-15, <br />Amending Chapter 700, Regarding Liquor and Beer, to Allow <br />Issuance of More than One On -Sale Intoxicating Liquor Licenses <br />Per Individual, (Addnl Licenses Available to Restaurants Only) <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />At work sessions in May and June, the council discussed Section 701.06 of the City Code that <br />states that "no more than one intoxicating liquor license shall be directly or indirectly issued <br />within the city to any one person." The subject matter arose because an individual who <br />currently holds an off -sale license in the city is opening a restaurant (also in the city) for which <br />he would like to secure a beer and wine license. <br />BACKGROUND <br />The council discussed how this code language impacts businesses, and particularly restaurants, <br />in the city. Information was presented on the history of the restriction, the council looked at <br />regulations in other area cities, and reviewed other regulatory options available when the council <br />considers future liquor license requests. <br />Current liquor license holders in the city were informed of the discussion and invited to a work <br />session to give input on the possibility of removing the one license per person restriction in the <br />city code. There was no negative reaction from licensees. <br />RECOMMENDATION <br />The council directed staff to prepare an ordinance amendment that removes the one license <br />restriction from the city code and that adds language that limits additional licenses to <br />restaurants only. <br />On June 8 the council approved the 1st Reading of Ordinance No. 02-15 as it was presented by <br />staff. It is now recommended that the council approve the 2nd Reading and Passage of <br />Ordinance No. 02-15, Amending Chapter 700 of the Lino Lakes Code of Ordinances Regarding <br />Liquor and Beer, to Allow Issuance of More than One On -Sale Intoxicating Liquor Licenses <br />per Individual, and Making Additional Licenses Available to Restaurants Only. <br />ATTACHMENTS <br />Ordinance No. 02-15 <br />
