Council Member Bohjanen introduced the following resolution <br />and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 51 - 90 <br />RESOLUTION FOR PARTIAL VACATION OF BLACK DUCK DRIVE AND <br />RESOLUTION FOR VACATION OF DRAINAGE AND UTILITY EASEMENTS <br />EACH RESPECTIVELY DEDICATED IN THE PLAT RESHANAU PARK ESTATES <br />IN THE CITY OF LINO LAKES, ANOKA COUNTY, MINNESOTA <br />WHEREAS: the ordinances of the City of Lino lakes provided <br />that the City Council may, by resolution, vacate <br />any street, alley, public grounds or public way or <br />any part thereof, when it appears in the interest <br />of the public to do so; and <br />the City of Lino Lakes has a utility easement over <br />Outlot A, Outlot B, Outlot C and Outlot D, RESHANAU <br />PARK ESTATES; <br />Black Duck Drive was dedicated in the plat RESHANAU <br />PARK ESTATES, Anoka County, Minnesota; and <br />a public hearing pursuant to notice given as <br />required by law was held on the 13th day of August, <br />1990; and <br />WHEREAS: it has been determined that good area planning <br />requires certain easements be vacated and that it <br />is in the public interest to do so. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LINO LAKES: <br />WHEREAS: <br />WHEREAS: <br />WHEREAS: <br />1. RESOLVED, that the following portion of Black Duck Drive <br />as dedicated in the plat RESHANAU PARK ESTATES, Anoka <br />County, Minnesota be vacated: <br />That part of Black Duck Drive as dedicated on the plat <br />of RESHANAU PARK ESTATES, according to the plat of <br />record thereof, Anoka County, Minnesota, lying <br />northwesterly of a line described as follows: <br />Commencing at the most easterly corner of Outlot D. said <br />RESHANAU PARK ESTATES, said corner also being the most <br />northerly corner of Lot 8, Block 2, said RESHANAU PARK <br />ESTATES; then north 46 degrees 37 minutes 59 seconds <br />West, assumed bearing, along the southwesterly line of <br />said Black Duck Drive, a distance of 163.44 feet; thence <br />northwesterly, continuing along said southwesterly line, <br />along a tangential curve concave to the northeast having <br />PAGE 1 <br />
