Council Member Elliott introduced the following <br />resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 92-70 <br />RESOLUTION ESTABLISHING SURFACE WATER MANAGEMENT CHARGES <br />BE IT RESOLVED BY THE CITY COUNCIL OF LINO LAKES MINNESOTA: <br />WHEREAS, the City of Lino Lakes is in the process of preparing a <br />Local (Surface) Water Management Plan for the purposes of managing <br />the requirements of the 1991 Wetland Conservation Act and other <br />needs created by development in the City, <br />WHEREAS, development of new land areas has an effect on the <br />functioning and balance of the surface water drainage system, <br />WHEREAS, it is necessary for the City to maintain a Surface Water <br />Management Fund to meet Administrative, Planning, Ponding, <br />Mitigation, and Water Quality needs of Surface Water and Wetland <br />management imposed by both State of Minnesota and Federal <br />Government regulations and legislation, <br />WHEREAS, estimated costs have been determined for Administration, <br />Planning, Ponding, Mitigation, and Water Quality needs, <br />WHEREAS, it is necessary to develop a revenue source to meet the <br />needs of this funding, <br />WHEREAS, it is necessary to set rates to provide for the <br />participation of developing properties in maintaining the Surface <br />Water Management Fund, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LINO LAKES, <br />MINNESOTA: <br />A. Six levels of charges are established by this <br />Resolution. These levels are established to allow a <br />project or a developer to earn credits toward satisfying <br />components of the six levels for work done. Maximum <br />credit for any component may not exceed the value of that <br />component at the appropriate applied rate. Subwatershed <br />channels and ponds eligible for credit are identified on <br />the City subwatershed drainage map. Local ponds, <br />channels, and storm sewers are at the cost of the project <br />or development. Water Quality projects will be <br />identified by the Water Quality Task Force in response to <br />governmental regulations and legislation and needs of the <br />City. <br />B. The Surface Water Management charges set by this <br />resolution shall be imposed: <br />
