Council Member Neal introduced the following <br />resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 14 - 93 <br />RESOLUTION VACATING EASEMENT FOR DRAINAGE AND UTILITY PURPOSES ON <br />PROPERTY 129.33' EAST OF LAKE DRIVE AND SOUTH OF OAK LANE (Parcel <br />No. 08-31-22-41-0030) AND PLACING AN EASEMENT FOR DRAINAGE AND <br />UTILITY PURPOSES ALONG THE CENTERLINE OF SAID PARCEL OF PROPERTY. <br />WHEREAS, the property owner has requested a vacation of <br />easements for drainage and utility purposes on property located <br />within the City of Lino Lakes, and <br />WHEREAS, the property owner has agreed to sign a waiver of <br />objections to future assessments for streets and utilities, and <br />WHEREAS, the easements were intended to serve as future <br />drainage and utility easements at such time as utility services <br />become available for this site, and <br />WHEREAS, the City Council has determined that the vacation of <br />two 20' wide easements for drainage and utility purposes is <br />reasonable provided a 10' wide easement for drainage and utility <br />purposes is located on the centerline of said parcel of property, <br />and <br />NOW, THEREFORE, BE IT RESOLVED that the following described <br />easement is hereby vacated: <br />An easement for drainage and utility purposes, in favor of the <br />City of Lino Lakes, over the west 20 feet of the east 162 feet, and <br />the west 20 feet of the east 86 feet, of TRACT 1A known as that <br />part of the North 235.00 feet of the Northeast Quarter of the <br />Southeast Quarter of Section 8, Township 31, Range 22, Anoka <br />County, Minnesota, lying westerly and northerly of the plat of <br />Carole's Estates, as recoreded and easterly of a line drawn 25.00 <br />feet easterly of and parallel with the East line of Lot 1, <br />Auditor's Subdivision No. 134. <br />
