Old Birch Street <br />Design on the north -south section and cul de sac on the north end of Old Birch Street is <br />50% complete. The City anticipates construction by fall 2016. <br />The east -west section of Old Birch Street will be reconstructed by the developer by fall <br />2016. <br />Future Fox Road and Public Utilities Connection <br />The City is drafting a purchase agreement with Comcast to acquire the south 550 feet of <br />their parcel to allow for the extension of Fox Road and public utilities to Foxborough. <br />The city will obtain financial securities from the developer to assure construction of these <br />improvements with phase three. <br />A wetland delineation has been completed on this area and the developer is starting <br />design of the Fox Road and public utility extension. Construction will coincide with the <br />submittal of the Saddle Club Third Addition in spring 2017. <br />Floodplain <br />The developer received a FEMA LOMR (Letter of Map Revision) on December 7, 2015 <br />effectively removing floodplain from 10 lots in Saddle Club First Addition. It should be <br />noted the floodplain has been removed from the required buildable house pad areas; <br />however, floodplain still exists along the rear of the lots. Future lenders may require <br />Letter of Map Amendments (LOMA) on these lots. <br />It should be noted the floodplain crosses just the north rear corner of Lot 1, Block 1, <br />Saddle Club Second Addition but is within the drainage and utility easement and outside <br />the buildable pad. It does not appear this area was included in the original LOMR and <br />future lenders may require a Letter of Map Amendments (LOMA) on this lot as well. <br />Development Agreement <br />A Development Agreement shall be drafted by the City, executed by the City and the <br />developer and recorded by the developer. <br />Title Commitment <br />The City Attorney reviewed the title commitment and final plat and notes Royal Oaks <br />shall transfer title to Dupont Holdings before the plat can be approved and recorded. The <br />title commitment legal description shall be revised to include Outlot B and C. <br />Stormwater Maintenance Agreement <br />A Maintenance Agreement for Stormwater Management Facilities was approved by the <br />2 <br />
