4.0.1 There is no Architect on this project. Instead, Roof Spec, Inc. (the <br />"Architect/Engineer") has been retained by the Owner to perform the <br />administrative duties which are usually performed by the Architect hereunder. <br />Wherever in this document the word "Architect" appears it should be replaced by <br />the words "Architect/Engineer". The term Architect/Engineer means the <br />Architect/Engineer or the Architect's/Engineer's authorized representative. <br />ARTICLE 8 <br />"Time" <br />Add to Article 8, Time, the following: <br />8.1.5 All acts or failures to act occurring prior to the relevant date of substantial <br />completion, any applicable statute of limitations shall commence to run and any <br />alleged cause of action shall be deemed to have accrued in any and all events not <br />later than such date of substantial completion; as to all acts or failures to act <br />occurring subsequent to the relevant date of substantial completion, any <br />applicable statute of limitations shall commence to run and any alleged cause of <br />action shall be deemed to have accrued in any and all events not later than the <br />date of issuance of the final certificate for payment. <br />ARTICLE 9 <br />"Payments and Completion" <br />Add the following sentence to subparagraph 9.3.1: <br />The form of application for payment shall be a notarized, if required, AIA <br />document G702, Application and Certificate for Payment supported by AIA <br />document G703, Continuation Sheet (1992). <br />Add the following clause to subparagraph 9.3.1: <br />9.3.1.1 Until substantial completion, the Owner shall make progress payments in the <br />amount of ninety per cent (90%) of the amount due the Contractor. <br />Add the following clause to subparagraph 9.10.1: <br />9.10.1.1 <br />Any payment application after substantial completion shall be sufficient to <br />increase the total payment to one hundred percent (100%) of the contract sum, <br />less such amounts as the Owner and Architect/Engineer shall determine for <br />incomplete work and unsettled claims. <br />City of Lino Lakes <br />Lino Lakes Fire Station #1 <br />RSI Project # 15-12120-02 <br />Supplementary Conditions of the Contract <br />00 73 00-3 <br />
