ARTICLE 3 <br />"Contractor" <br />Add to Article 3, Contractor, the following: <br />3.1.4 The operations of the Owner cannot be interrupted or disturbed except on an <br />approved scheduled basis, the Contractor shall restrict his operations, including <br />the storage of equipment and materials, to those areas designated by the Owner. <br />3.4.4 The Contractor shall deliver, handle, store and install materials in accordance with <br />the more restrictive of the manufacturer's instructions or contract documents. <br />3.4.5 The Contractor shall be responsible for the security of all materials and equipment <br />used in the performance of the work. <br />3.4.6 After the contract has been executed, the Owner and Architect/Engineer will <br />consider a formal request for the substitution of products in place of those <br />specified only under the conditions set forth in the general requirements of the <br />specifications (Division 1). <br />3.4.7 By making requests for substitutions based on clause 3.4.6 above, the Contractor: <br />(1) Represents that the Contractor has personally investigated the proposed <br />substitute product and determined that it is equal or superior in all respects to that <br />specified; (2) Represents that the Contractor will provide the same warranty for <br />the substitution that the Contractor would for that specified; (3) Certifies that <br />the cost data presented is complete and includes all related costs under this <br />contract but excludes costs under separate contracts, and excludes the <br />Architect's/Engineer's redesign costs, and waives all claims for additional costs <br />related to the substitution which subsequently become apparent; and (4) Will <br />coordinate the installation of the accepted substitute, making such changes as may <br />be required for the work to be complete in all respects. <br />3.13.1 The Contractor shall take special care to prevent damage to grass, shrubbery, trees <br />and other site improvements. The Contractor shall replace any damaged items <br />caused by the operations of this project to the satisfaction of the Owner and <br />without any additional cost to the Owner. <br />ARTICLE 4 <br />"Architect" <br />Add to Article 4, Architect, the following: <br />4.0 ARCHITECT/ENGINEER <br />Supplementary Conditions of the Contract <br />00 73 00-2 <br />City of Lino Lakes <br />Lino Lakes Fire Station #1 <br />RSI Project # 15-12120-02 <br />
