3. Types of equipment and kinds of materials to be used if not specifically <br />indicated in specifications, must be approved in writing by <br />Architect/Engineer and be agreed upon by Owner prior to letting of <br />contract. <br />4. No substitution will be allowed after letting of contract. <br />5. Conditional bids will not be accepted. <br />C. Voluntary Alternate Bids: Not Applicable. <br />D. Signing of Bids: Sign bid forms according to the following conditions as they <br />may apply: <br />1. Attach a power of attorney to bid, if necessary, evidencing authority to <br />sign bid in name of person for whom it is signed. <br />2. Sign bid for partnership by all partners or by attorney-in-fact. <br />3. If signed by an attorney-in-fact, attach power of attorney evidencing <br />authority to sign. <br />4. Append correct corporate name to bid which is signed for a corporation. <br />5. Append written signature of president or other authorized officer of <br />corporation below written or typewritten corporate name following the <br />word "by". <br />6. If a bid by a corporation is manually signed by official other than <br />president of corporation, attach a certified copy of resolution of board of <br />directors evidencing authority of such official to sign. <br />E. Bid Security <br />1. Submit together with bidder's bid form, bid security in form of a certified <br />check made payable to Owner in the amount of not less than 5% of total <br />bid, or: <br />2. A bid bond on AIA form A310, in like amount, payable to Owner. <br />3. Surety company thereon must be duly authorized to do business in state of <br />construction. <br />4. Bid security to guarantee that bidder will not, without consent of Owner, <br />withdraw their bid. <br />5. Owner, will require Contractor to provide a 100% performance bond to <br />include labor and materials as required by law and in form as set forth in <br />specifications. <br />6. Owner will retain bid securities of three lowest responsible bidders no <br />longer than 30 days after the opening of bids. <br />7. Owner will retain bid security of successful bidder until contract is <br />executed. <br />8. Owner will return bid securities of unsuccessful bidders within ten (10) <br />days after opening of bids. <br />9.
