The Final <br />AUAR comment period expired on April 13, 2009. <br />The city did not receive any formal objections to the Final AUAR; therefore, the Lake <br />Elmo City Council can adopt the Final AUAR and Mitigation Plan. In accordance with <br />Minnesota Rules, after the City Council adopts the Final AUAR and Mitigation Plan, <br />future residential and commercial projects and associated infrastructure within <br />the AUAR area that are consistent with the assumptions of the Final AUAR and <br />that comply with the Mitigation Plan are exempt from further environmental <br />review (i.e., EAW, EIS, AUAR). <br />Although no objections were filed, the city received five comment letters. The city is <br />not required to formally respond to non -objecting comments, but can chose to <br />address such comments. The city received comments from the following <br />organizations and individuals: <br />• Andrew Nath, Premier Bank <br />• Ronald Wieland, Minnesota Department of Natural Resources <br />• Phyllis Hanson, Metropolitan Council <br />• John Hanson, Valley Branch Watershed District <br />• Ann Bucheck, Lake Elmo Resident <br />A summary of the comments received and suggested revisions to the final document <br />follow. <br />Andrew Nath, Premier Bank <br />Comment Summary: Requested that the Village Area accommodate 1,600 units and <br />that the 100-acre Heritage Development site accommodate 160 single family units. <br />Response: The AUAR does not make any direct assumptions concerning the specific <br />location or distribution of units within the Village Area. Upon the final adoption of the <br />AUAR, the city could move forward with amendments to the Comprehensive Plan to <br />identify a preferred development option. In this case, the city may choose to move <br />forward with the exiting Comprehensive Plan or adopt the Village Land Use Plan with <br />600, 1,000, or 1,600 housing units. There will be additional opportunities for <br />comments during the review process for any future Comprehensive Plan Amendments <br />for the Village. <br />
