CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2009 - <br />A RESOLUTION AUTHORIZING THE PARTICIPATION OF THE CITY OF LAKE ELMO <br />ON THE JOINT AIRPORT ZONING BOARD <br />FOR THE LAKE ELMO AIRPORT <br />WHEREAS, the Metropolitan Airports Commission (MAC) has proposed the establishment of a <br />Joint Airport Zoning Board (JABZ) for the Lake Elmo Airport; and <br />WHEREAS, the MAC has invited the City of Lake Elmo to participate on the JABZ; and <br />WHEREAS, Section 360.063 of Minnesota Statutes addresses joint airport zoning boards and <br />indicates, among other things, that while a city's participation on such a board is <br />optional, the city will be subject to the actions of the board; and <br />WHEREAS, the City Council prefers to participate in organizations that may affect its land use <br />authority; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo that it <br />hereby authorizes the City's participation on the Joint Airport Zoning Board for the Lake Elmo <br />Airport; <br />BE IT FURTHER RESOLVED that in participating on the JABZ, the City Council expects that the <br />MAC will provide indemnification to the City from claims based upon the City's adoption of more <br />restrictive zoning standards which could have an adverse impact on property values within hazard <br />zone areas; <br />AND BE IT FURTHER RESOLVED that, subsequent to the adoption of this Resolution, the City <br />Council will endeavor as quickly as it is able to appoint two representatives to serve on the JABZ. <br />ADOPTED by the City Council of the City of Lake Elmo on May 5th, 2009 <br />ATTEST: <br />Dean A.
