to the City Council as part of a StaffMemorandum dated October 3, 2017; and <br />WHEREAS, the City Council considered said matter at its meetings on October <br />3, 2017 and October 17, 2017; <br />NOW THEREFORE BE IT RESOLVED based upon the testimony elicited and <br />inforniation received, the City Council makes the following findings of fact: <br />FINDINGS <br />1. That the Applicant has submitted a request for a Zoning Map Amendment in <br />accordance with the procedures as established by the Lake Elmo Planning <br />Department and Lake Elmo Planning Commission. <br />2. That the request is to amend the Zoning Map by rezoning the Property from RT — <br />Rural Development Transitional to A — Agricultural. <br />3. That the rezoning the Property to A - Agricultural is inappropriate because the <br />Property is located within the MUSA and agricultural property does not utilize <br />municipal services whereas the RT- Rural Development Transitional District is for <br />land that will connect to regional sewer service. <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Lake Elmo <br />City Council hereby denies the request by Mare Affair Farm, LLC to amend the City of Lake <br />Elmo Zoning Map by re-zorring the Property from RT — Rural Development Transitional to A — <br />Agricultural. <br />Passed and duly adopted this 17th day of October 2017, by the City Council of the City of Lake <br />Elmo, Minnesota. <br />2 <br />Mike Pearson, Mayor <br />ATTEST: <br />QJI' Johns h n s 4in, ty Clerk <br />5090 1 Ov I S1S LA515-1 <br />
