25 <br />facilities, other government facilities or other designated facilities (other than those <br />indicated in paragraph 7.9); or <br /> <br />(b) that the City desires to establish or change a location from which PEG <br />programming is originated; or <br /> <br />(c) that the City desires to upgrade the connection to Grantee from an existing signal <br />point of origination, <br /> <br />the City will give Grantee written notice detailing the point of origination and the capability sought <br />by the City. After receipt of such notice by Grantee, Grantee and the City may enter into an <br />agreement which compensates Grantee in accordance with Applicable Law, for new sites added <br />or upgraded connections. After such an agreement has been executed, Grantee will implement any <br />necessary Cable System changes within a reasonable period of time. Nothing herein prevents the <br />City, or a private contractor retained by the City, from constructing said connection, as long as such <br />connection does not interconnect with Grantee’s Cable System without Grantee’s consent or <br />interfere with Grantee’s Cable System. <br /> <br />7.12 PEG Channel Carriage. <br /> <br />(a) The City or its designee shall be responsible for developing, implementing, <br />interpreting and enforcing rules for PEG Channel use. <br /> <br />(b) The Grantee shall monitor the PEG Channels for technical quality to ensure that <br />they meet FCC technical standards including those applicable to the carriage of PEG <br />Channels, provided however, that the Grantee is not responsible for the production quality <br />of PEG programming productions. The City, or its designee, shall be responsible for the <br />production and quality of all PEG programming. Grantee shall carry all components of <br />the SD/HD PEG Channel(s) including, but not limited to, closed captioning, stereo audio <br />and other elements associated with the programming. <br /> <br />7.13 PEG Programming Financial Support. <br /> <br />(a) In accordance with the schedule below, during the term of the Franchise, Grantee <br />shall pay quarterly to the Commission a public, educational, and governmental <br />programming capital support fee (herein the “PEG Fee”) in an amount equal to the <br />following percentages of its quarterly Gross Revenues: <br /> <br />Beginning April 1, 2021 (expected <br />effective date of renewed franchise) <br />3.25% of gross revenue <br />Beginning April 1, 2022 3% of gross revenue <br />Beginning April 1, 2023 through <br />remaining term of franchise, which will <br />end on April 1, 2031. <br />2.75% of gross revenue
