B-1 <br /> <br />EXHIBIT B <br />CABLE SERVICE AND PHASE OUT OF DARK FIBER SERVICES TO PUBLIC <br />BUILDINGS <br /> <br />a. One or more Member Cities may request basic cable service at those locations <br />attached to this Exhibit B that were receiving complimentary services and equipment under <br />the previous franchise. Each location includes one drop, one activated outlet, and one cable <br />box and remote control (if required). Grantee, City, and the Commission agree that under <br />the FCC Section 621 Order, Third Report and Order in MB Docket No. 05-311 adopted by <br />the FCC on August 1, 2019 (currently pending appeal), complimentary accounts are not a <br />condition of the Franchise. Grantee will charge fair market value prices for former <br />complimentary service locations (current pricing is attached to this Exhibit B) and accounts <br />shall be subject to Grantee’s regular, nondiscriminatory rate adjustments. On the Effective <br />Date of the Franchise, for those locations attached to this Exhibit B already receiving <br />complimentary services and equipment, Grantee will continue to provide the outlets, <br />equipment and the remote controls, if any, subject to the provisions of this Exhibit B. <br /> <br />b. Additional subscriber network Drops and/or outlets will be installed at designated <br />institutions by Grantee at the cost of Grantee's time and material, or such other price as <br />may be required to comply with Applicable Law. Alternatively, said institution may add <br />outlets at its own expense as long as such installation meets Grantee's standards. Grantee <br />will complete construction of the additional Drop and outlet within three (3) months from <br />the date of City’s designation of additional institution(s) unless weather or other conditions <br />beyond the control of Grantee requires more time. The communities may substitute <br />locations listed on the attachment to this Exhibit B subject to the new location being within <br />250 feet of existing distribution lines (if further than 250 feet from existing distribution <br />lines, communities must pay the additional actual cost of installing a longer drop). <br /> <br />c. The City or the locations will pay the service rate for each location set forth on the <br />attachment to this Exhibit B commencing sixty (60) days after notification from Grantee. <br />Grantee will notify the City of any locations for which it elects at its sole discretion not to <br />impose a charge within thirty (30) days of the effective date of the franchise. <br />Commission/City or former Complimentary Service recipients (schools, libraries, et al.) <br />have the right to choose to retain Cable Service at the rates listed on the municipal pricing <br />sheet or terminate Cable Service to their Location. Each location identified on the <br />attachment to this Exhibit B that chooses to retain Cable Service shall receive one Drop, <br />one activated outlet, and one cable box and remote control (if required) as part of the rate <br />listed on the attachment to this Exhibit B. Additional tiers of cable service and equipment <br />may be purchased at rate card rates. <br /> <br />d. In the event there is a change in Applicable Law, and franchise-mandated <br />complimentary services to public buildings are no longer considered to be “franchise fees” <br />under 47 USC §542, then for the remaining Franchise term Commission/City may require <br />Comcast to provide basic Cable Service to the former Complimentary Service Locations <br />attached to this Exhibit B at an adjusted rate or on a complimentary basis consistent with <br />such change in Applicable Law.
