The Developer is not required to <br />construct the trail that will be located over Outlot D and Outlots G and F of the <br />Subdivision until it develops The Royal Golf Club at Lake Elmo 6th Addition. The <br />Developer will be responsible for the costs of constructing the trail. <br />H. The Developer shall enter into a Landscape License Agreement with the City that <br />clarifies the individuals or entities responsible for maintenance of any landscaping <br />installed in areas outside of land dedicated as public park and open space on the <br />final plat. <br />I. The Developer shall pay the City a cash contribution of $90,343 to satisfy the City’s <br />park dedication requirements for the fifth phase of the development. <br />J. The Developer shall pay the City a park dedication fee of $42,955.67 for required <br />trees not planted within the Subdivision as per paragraph 19 (C) of this Agreement. <br />This fee was calculated as follows: (($300 X 969 2.5-caliper inch trees reduced within <br />the entire Development) / 291 Single Family Lots within the Development X 43 Single <br />Family Lots within the Subdivision). <br />K. The Developer shall follow all of the rules and regulations spelled out in the Wetland <br />Conservation Act and shall acquire the needed permits from the appropriate <br />watershed districts prior to the commencement of any grading or development <br />activity on the site. <br />L. That the Subdivision will only have street lights at street intersections, trail <br />intersections, and cul-de-sacs. <br />M. The Developer shall be responsible for all costs related to the design and <br />construction of the lift station serving the Subdivision, including all costs associated <br />with start-up and operation through the warranty period. The Developer shall also <br />pay to the City a cash contribution of $25,000.00 for the future maintenance costs of <br />a lift station that will be serving the Subdivision.
