10/16/23, 9:55 AM Print Preview <br />https://lakeelmo.municipalcodeonline.com/book/print?type=ordinances&name=TITLE_1_GENERAL_PROVISIONS 11/48 <br />representative. <br />Building setback means the minimum horizontal distance between one building and the lot line. <br />Building setback line means a line within a lot parallel to a public right-of-way line, a side or rear lot line, <br />a bluff line, or a high water mark or line, behind which buildings or structures must be placed. <br />Building sewer means the part of the drainage system which extends from the building drain to the <br />point of connection to either a public sewer, a septic tank, a pumping chamber, or an individual sewage <br />treatment system, for the purpose of conveying wastewater. This definition shall not apply to LEC <br />5.08.010 through LEC 5.08.050. <br />Business means any occupation, employment, or enterprise where merchandise is exhibited or sold, or <br />where services are offered for compensation. <br />Business of refuse collection means operating a refuse collection service for hire. <br />Canopy means a detachable, roof-like cover, supported from the ground or deck, floor or walls of a <br />structure, for protection from the sun or weather. <br />Capacity (sewer systems) means the internal liquid volume of a sewage tank below the outlet level. <br />This definition shall not apply to LEC 5.08.010 through LEC 5.08.050. <br />Carport means an automobile shelter having one or more sides open. <br />Cellar means the portion of the building having more than one-half of the clear floor-to-ceiling height <br />below the average grade of the adjoining ground. <br />Cesspool means an underground pit into which raw household sewage or other untreated liquid waste <br />is discharged and from which the liquid is allowed to seep into the surrounding soil. This definition shall <br />not apply to LEC 5.08.010 through LEC 5.08.050. <br />Channel means a natural or artificial watercourse with definite bed and banks to confine and conduct <br />continuously or periodically flowing water, including, but not limited to, streams, river, creeks, ditches, <br />drainageways, canals, conduits, culverts, waterways, gullies, ravines, or washes; and including any <br />area adjacent to the watercourse, which is subject to inundation by reason of overflow or floodwaters. <br />Church means a building, together with its accessory buildings and uses, where persons regularly <br />assemble for religious worship and which building, together with its accessory buildings and uses, is <br />maintained and controlled by a religious body organized to sustain public worship. <br />Cigarette vending machine means any automatic vending machine used for the sale of cigarettes and <br />matches, and controlled by the insertion of coins; it shall not include machines or devices used solely <br />for the vending of service, food, or confections. <br />City means the area within the corporate boundaries of the city as presently established or as amended <br />by ordinance, annexation, or other legal actions at a future time. The term "city" may also be used to <br />refer to the city council and its authorized representatives. <br />City's trade area means the area located within the city limits and the area located within the limits of all <br />Minnesota cities and townships which are contiguous to the city. <br />Civil defense means the preparations for and the carrying out of all emergency functions. <br />Civil defense emergency means an emergency declared by the governor under state statutes, or an <br />emergency proclaimed by the mayor.
