10/16/23, 9:55 AM Print Preview <br />https://lakeelmo.municipalcodeonline.com/book/print?type=ordinances&name=TITLE_1_GENERAL_PROVISIONS 10/48 <br />Block means an area of land within a subdivision that is entirely bounded by streets, or by streets and <br />the exterior boundary or boundaries of the subdivision, or a combination of the above with a river or <br />lake. <br />Bluff means a topographic feature such as a hill, cliff, or embankment having the following <br />characteristics; however, an area with an average slope of less than 18 percent over a distance of 50 <br />feet or more shall not be considered part of the bluff: <br />(a)Part or all of the feature is in a shoreland area; <br />(b)The slope rises at least 25 feet above the ordinary high water level of the water body; <br />(c)The grade of the slope from the toe of the bluff to a point 25 feet or more above the ordinary <br />high water level averages 30 percent or greater; and <br />(d)The slope must drain toward the water body. <br />Bluff impact zone means a bluff and land located within 20 feet from the top of a bluff. <br />Boardinghouse means a building other than a motel or hotel where, for compensation and by pre- <br />arrangement for definite periods, meals or lodging are provided for three or more unrelated persons, <br />but not to exceed eight persons. <br />Boathouse means a structure designed and used solely for the storage of boats and boating <br />equipment. <br />Bona fide club means a club organized for social or business purposes, for intellectual improvement, or <br />for the promotion of sports, where the serving of 3.2 percent malt liquor is incidental to and not a major <br />purpose of the club. <br />Boulevard means the portion of the street right-of-way between the curb line and the property line. <br />Buildable land area means the gross land area less the unbuildable land area that includes hydric and <br />restrictive soils, land with slopes over 25 percent, wetlands, areas that cannot accommodate septic <br />systems, and land that has been acquired for municipal purposes. <br />Building means any structure, either temporary or permanent, having a roof and used or built for the <br />shelter or enclosure of any person, animal, or movable property of any kind. When any portion of a <br />building is completely separated from every other part of a building by area separation, each portion of <br />the building shall be deemed as a separate building. <br />Building code means the state building code. <br />Building footprint means the outline of the total area covered by a building's perimeter at the ground <br />level. <br />Building height means the vertical distance between the average of the ground level elevations to the <br />top of a flat roof, the deck line of a mansard roof, or the midpoint on a pitched roof which is between the <br />highest point (peak of building) and lowest point (bottom of the truss at the top plate of the wall) on the <br />roof. <br />Building line means a line parallel to a lot line or the ordinary high water level at the required setback <br />beyond which a structure may not extend. <br />Building official means the officer or other designated authority, certified by the state, charged with the <br />administration and enforcement of the state building code, or the building officer's duly authorized
