It shall be unlawful for any person, partnership, company, or <br />corporation to engage in mining within the city or for an owner to permit a person to mine on the <br />owner's property, without first having obtained a conditional use permit for mining from the <br />council. <br />(b)Application and review of conditional use permit. The applicant shall submit an application <br />together with the required fees to the planning commission. Property owners within 350 feet <br />shall be notified by certified mail ten days prior to the date the planning commission considers <br />the request. The planning commission shall consider the request at its next regularly scheduled
