The Applicant must submit a revised preliminary plat and project plans meeting all <br />conditions of approval for City review and approval. The revised Applicant project plans <br />and other materials shall meet all of the above conditions before the City will find complete <br />any final plat application for the development and before the start of any clearing or grading <br />activity on the site. <br />19. That the Applicant must submit the final plat within 180 days after City Council approval of <br />the preliminary plat or approval of the preliminary plat shall be considered void unless a <br />request for a time extension is submitted in writing and approved by the City Council. <br /> <br />Conditional Use Permit. <br />1. Submission of the Comprehensive Plan amendment to the Metropolitan Council and the <br />receipt of formal notification from the Metropolitan Council that it has reviewed and approved <br />the proposed Comprehensive Plan amendment. <br />2. Approval of a preliminary and final plat for Bridgewater Village by the City Council must <br />occur prior to establishment of this use. <br />3. All required state, local, and federal permits and reviews must be received prior to <br />establishment of this use on the Property. <br />4. No flexibility from City standards is provided by this approval. <br />5. The drive-through facility must comply with all standards for such facilities that are set forth <br />in City Code Section 105.12.570(b). <br />6. Enhanced landscaping between the drive-through facility on the Property and the intersection <br />of CSAH 14 & 15 shall be provided to the satisfaction of the City’s Landscape Architect. <br />7. If substantial construction has not taken place within 12 months of the date on which the <br />conditional use permit was approved by the City Council, the conditional use permit is void, <br />except that, on application to the City Council, after receiving recommendation of the Planning <br />Commission, the City Council may extend the permit for such additional period as it deems <br />appropriate. <br />8. If the conditional use is discontinued for six months, the conditional use permit shall become <br />void. <br /> <br />PREMATURE SUBDIVISIONS <br />Staff acknowledge the City Council’s concerns regarding water appropriations. If the City Council <br />finds that it is not in the best interests of the City to approve development, and that this request is <br />considered a Premature Subdivision, it would have to articulate such concerns and find that <br />conditions exist to warrant a denial on that basis. The City’s Premature Subdivisions ordinance is <br />found in Section 103.00.025. Subsection C, Lack of adequate water supply, is copied as follows: <br /> <br />Lack of adequate water supply. Unless the city has guided the site of the proposed plat or <br />subdivision as rural by the comprehensive plan, a proposed plat or subdivision may be <br />deemed premature if municipal water is not available to serve the proposed subdivision if <br />it is developed to its maximum permissible density without causing and unreasonable <br />depreciation of existing municipal water supplies. The term “available” shall mean <br />existing or readily extended and funded consistent with the phasing in the comprehensive <br />plan, the capital improvement program, and any relevant city ordinances, plans, and
