The term “available” shall mean <br />existing or readily extended and funded consistent with the phasing in the comprehensive <br />plan, the capital improvement program, and any relevant city ordinances, plans, and <br />policies. If the site of the proposed plat or subdivision is guided as rural by the <br />comprehensive plan, a proposed subdivision shall be deemed premature with respect to a <br />lack of adequate water supply if a private well or wells cannot adequately or safely serve <br />the proposed subdivision. <br /> <br />FISCAL IMPACT: Approval of the Applicant’s requests grant entitlements to the Applicant, <br />however there would be no fiscal impact to the City at this time. A final plat is required along with <br />a Development Agreement which will detail public improvements and address fiscal impacts. <br />When the property begins to develop it will have urban services and will require development fees. <br /> <br />PUBLIC HEARING: <br />A public hearing is required for this item. The Planning Commission should hold the dually <br />noticed hearing prior to providing a recommendation to the City Council. At the time of writing, <br />no comments have been received on this project. <br /> <br />RECOMMENDATION: <br />This project is located within the City’s existing MUSA boundary, and specifically the 2020- <br />2030 development decade. The City’s Comprehensive Plan is consistent with regional policies <br />for growth and development. Based on the above analysis of the proposed development, City <br />staff find the proposal to be generally in line with the City’s adopted ordinances, plans, and <br />policies. Staff is therefore recommending the City Council conditionally approve the project. <br /> <br />Recommended Motions: <br /> “Move to adopt Resolution 2024-024 approving the preliminary plat and PUD requested by At <br />Home Apartments, LLC, for Lake Elmo Townhomes based on the findings of fact and <br />conditions therein.” <br />And <br /> <br />“Move to adopt Ordinance 2024-06 approving the PUD Ordinance for the development <br />proposed by At Home Apartments subject to the approval of a Final Plat and PUD.” <br /> <br />And <br /> <br />“Move to adopt Resolution 2024-025 approving the Summary publication of Ordinance 2024- <br />06.” <br /> <br />ATTACHMENTS: <br />1.
