1 <br /> <br /> <br /> STAFF REPORT <br /> DATE: 3/12/2024 WORKSHOP DISCUSSION <br /> <br />TO: City Council <br />FROM: Nathan Fuerst, AICP, Consulting Planner <br />AGENDA ITEM: Sketch Plan Review – Legends of Lake Elmo Proposal by Landucci <br />Construction <br />REVIEWED BY: Jason Stopa, Community Development Director <br /> Clark Schroeder, Interim City Administrator <br />Jenni Faulkner, Senior Consulting Planner <br /> <br /> <br />BACKGROUND: <br />The City is in receipt of a Sketch Plan application from Landucci Construction for the proposed <br />Open Space development on three contiguous unaddressed properties south of the St. Croix’s <br />Sanctuary development and West of Carriage Station. The proposal would consist of 50 single <br />family residential units across 110 acres of undeveloped agricultural land located off 50th Street <br />North corridor. The development is proposed to connect Linden Ave North from the St. Croix <br />Sanctuary Development south to 50th St. North. The proposal would have a community septic <br />system (outside of the MUSA boundary) and be connected to city water. <br /> <br />A review of the concept plan and narrative supplied by the applicant is provided in the staff <br />memos attached to this report. Additional information was received from the Applicant on <br />February 26, 2024. The staff memos attached to this report do not consider those materials which <br />are also attached to this report. <br /> <br />ISSUE BEFORE THE CITY COUNCIL: <br />The City has not approved a proposal for an OS PUD in years. Since PUD’s recognize the <br />uniqueness of a site and the proposed development, they have different considerations and <br />conditions. The City Council should provide feedback regarding the sketch plan and advise <br />Landucci Construction on City preferences to move forward with the proposed development. <br /> <br />ENTITLEMENTS REQUIRED: <br />Staff have reviewed the concept level plan against the adopted 2040 Comprehensive Plan and the <br />City’s Zoning and Subdivision standards. The site is zoned Rural Residential (RR) allowing a <br />density of .1 units per acre and guided Rural Area Development (RAD) in the Comp Plan with a <br />stated density range of .1 units per acre. <br /> <br />The following approvals will be required for this project to be permitted: <br />1. Open Space Planned Unit Development (OS PUD) – The Applicant has requested greater <br />flexibility than is allowed by the City’s OS PUD ordinance (Chapter 105.12, Article 17) <br />which must be approved by a supermajority (4/5ths) vote. <br />2. Major Subdivision – Required by the City’s ordinance to subdivide the property and allow <br />for dedication of easements and Rights of Way.
