<br /> 8 <br />LA515\112\937837.v1 <br />conditioned upon updating the Security posted by the Developer to reflect cost increases and <br />amending this Agreement if necessary to reflect the extended completion date. Final wear course <br />placement outside of this time frame must have the written approval of the City Engineer. <br />12. MAINTENANCE DURING CONSTRUCTION. The Developer shall be responsible for <br />all maintenance of the Subdivision Improvements including the snow plowing of the streets, roads <br />and alleys until the Subdivision Improvements are accepted by the City in writing. The Developer <br />and its contractors must adhere to the City’s weight restrictions for all streets both inside and <br />outside of the Subdivision, regardless of whether said streets are included in the City’s map of <br />streets with weight restrictions and regardless of whether said streets are fully constructed. The <br />Developer also is responsible to locate all underground utilities until the Subdivision is accepted <br />in writing by the City. Warning signs shall be placed by the Developer when hazards develop in <br />streets to prevent the public from traveling on same and to direct attention to detours. If and when <br />streets become impassable, such streets shall be barricaded and closed by the Developer. In <br />the event residences are occupied prior to completing streets, the Developer shall maintain a <br />smooth surface and provide proper surface drainage to ensure that the streets are passable for <br />traffic and emergency vehicles. The Developer shall be responsible for keeping streets within <br />and without the Subdivision clean and clear of dirt and debris that may spill, track, or wash onto <br />the street from the Developer’s operations. The Developer shall contract for street cleaning for <br />streets within and immediately adjacent to the Subdivision. At a minimum, scraping and sweeping <br />shall take place on a weekly basis. <br />Prior to the City’s acceptance of the streets the City may agree, at the City’s sole <br />discretion, to keep the streets open during winter months by plowing snow. The City will consider <br />snow plowing streets on a case by case basis and under the following conditions: 1) the Developer <br />must request in writing the streets it is requesting to be plowed by the City, with such request <br />received prior to October 1st of each winter season that plowing is requested; 2) there must be
