<br /> 9 <br />LA515\112\937837.v1 <br />residences along the street; 3) for streets that do not have the bituminous wear course placed, <br />the Developer must install paved wedges along all curb lines and catch basins of the street; 4) <br />gate valves and manholes must be level with the pavement surface; 5) street curves, center <br />medians, and other protrusions in the rights-of-way must be delineated with “HI-VIS” fiberglass <br />stakes; 6) a site review must be scheduled by the Developer and conducted with the City’s Public <br />Works Department with the Developer in attendance to review the streets that are being <br />requested to be plowed prior to the commitment of plowing by the City; 7) the Developer must <br />agree not to hold the City responsible for any damage caused by snow plowing operations to the <br />streets, curb and gutter, manholes, catch basins or other infrastructure; and 8) the Developer shall <br />enter into an agreement with the City for plowing of the streets. <br />13. LICENSE. The Developer hereby grants the City, its agents, employees, officers, and <br />contractors a license to enter the Property to perform all work and inspections deemed <br />appropriate by the City in conjunction with the development of the Property and this Agreement. <br />14. CONSTRUCTION ACCESS. Construction traffic access and egress for grading, public <br />utility construction, and street construction is restricted to access the Subdivision via Lake Elmo <br />Avenue (County Road 17) or Stillwater Boulevard North (County Road 14) at a designated <br />construction site entrance as approved by Washington County. No construction traffic is <br />permitted on other adjacent local streets. No traffic obstructions, staging, and no parking is <br />permitted along Lake Elmo Avenue (County Road 17), Stillwater Boulevard North (County Road <br />14), or along 39th Street at any time, including loading and unloading of equipment. All construction <br />staging and parking,and loading and unloading of equipment must be completed internal to the <br />construction site. <br />15. CONSTRUCTION SEQUENCE AND COMPLIANCE. The City will require the <br />Developer to construct the Subdivision Improvements in a sequence which will allow progress <br />and compliance points to be measured and evaluated.
