7 <br />LA515\137\947791.v5 <br />to reflect cost increases, if any, and amending this Agreement to reflect the extended completion <br />date. <br />11. MAINTENANCE DURING CONSTRUCTION. The Developer shall be responsible for <br />all maintenance of the Subdivision Improvements including the snow plowing of the streets until <br />the Subdivision Improvements are accepted by the City in writing. The Developer and its <br />contractors must adhere to the City’s weight restrictions for all streets both inside and outside of <br />the Subdivision, regardless of whether said streets are included in the City’s map of streets with <br />weight restrictions and regardless of whether said streets are fully constructed. The Developer <br />also is responsible to perform Gopher State One utility locates for all underground utilities until <br />the Subdivision Improvements are accepted in writing by the City. Warning signs shall be placed <br />by the Developer when hazards develop in streets to prevent the public from traveling on same <br />and to direct attention to detours. If and when streets become impassable, such streets shall be <br />barricaded and closed by the Developer. The Developer and its contractors working on building <br />or site improvements internal to the site must keep all public streets, including Stillwater Boulevard <br />and Stillwater Way open to traffic at all times unless a right-of-way obstruction permit is obtained <br />from the City. The Developer shall be responsible for keeping streets within and outside of the <br />Subdivision clean and clear of dirt and debris that may spill, track, or wash onto the street from <br />the Developer’s operations. The Developer shall contract for street cleaning for streets within and <br />immediately adjacent to the Subdivision until the Subdivision Improvements have been accepted <br />by the City. At a minimum, scraping and sweeping shall take place on a weekly basis and on a <br />daily basis during heavy tracking days. <br />12. LICENSE. The Developer hereby grants the City, its agents, employees, officials, and <br />contractors a license to enter the Subdivision to perform all work and inspections deemed <br />appropriate by the City in conjunction with the development of the Subdivision and this <br />Agreement.
