10 <br />LA515\137\947791.v5 <br />prepare the site for development, it will be necessary for the Developer to grade the Subdivision <br />property. All grading must be done in compliance with this Agreement and the grading plans on <br />file with the City. Within 30 days after completion of the grading, the Developer shall provide the <br />City with an “as built” grading plan and a certification by a registered land surveyor or engineer <br />as required in the City’s Engineering Design and Construction Standards Manual. The City will <br />not accept the site grading or release the related security until the grading as-built plans have <br />been received and documents that all construction tolerances have been achieved. <br />17. STREET AND UTILITY IMPROVEMENTS. All storm sewers, sanitary sewers, <br />watermain, and streets, including any turn lane or intersection improvements, shall be installed in <br />accordance with the approved Plans, the City approvals, the City Code, and the City’s <br />Engineering Design and Construction Standards Manual. Curb and gutter, the first lift of the <br />bituminous streets, trails, boulevards graded, street signs installed, and all restoration work on <br />the site shall be completed in accordance with the approved Plans. Once the work is completed, <br />the Developer or the Developer’s representative shall submit a written request to the City asking <br />for an inspection of the initial improvements. The City will then schedule a walk- through to create <br />a punch list of outstanding items to be completed. Upon receipt of the written punch list provided <br />by the City, the punch list items must be completed by the Developer and the City notified to re- <br />inspect the improvements. The Developer shall install the final bituminous wear course after the <br />first bituminous course has weathered a winter season. Before the placement of the final <br />bituminous wear course, the Developer shall repair or replace all broken or failing curbs, trails <br />and damaged or settled streets as determined by the City from a pre-wear course walk through <br />inspection. <br />18. LANDSCAPING AND TREE REPLACEMENT IMPROVEMENTS. <br />A. The Developer agrees to install or cause to be installed landscaping in accordance <br />with the approved Plans, the City approvals, the City Code, the City’s Engineering
