CUP and Preliminary Plat Submittal, dated 8/19/24 received 8/26/24 <br />REVIEW HISTORY <br />1. 09/12/24 – CUP and Preliminary Plat Landscape Plan Review <br />LOCATION: Northwest corner of the intersection of 10th Street North and Lake Elmo Avenue North <br />CURRENT LAND USE CATEGORY: Public Facilities (PF) <br />ADJACENT AND SURROUNDING LAND USE: PF and Rural Single Family to the north, Rural <br />Single Family to the east, and Rural Single Family and Rural Residential to the south and west <br />(including the gun club) <br />SPECIAL LANDSCAPE PROVISIONS: 750’ sound buffer from adjacent gun club. Exemption <br />request for mitigation of owner-planted trees. <br /> <br />TREE PRESERVATION PLAN: 105. 12. 470 <br />• A tree preservation plan will need to be submitted that meets code, including, but not limited to: <br />o The applicant has submitted supplementary information that supports the granting of a variance <br />that would allow them not to mitigate trees planned to be removed that were planted by the <br />previous landowner. As such; these trees will not be considered in the tree preservation and <br />mitigation calculations. However, the removal of more than 30% of the naturally occurring <br />significant tree inches onsite still requires mitigation. <br />o 1,969 qualifying (naturally occurring) significant inches exist. 590 are allowed to be removed <br />without mitigation. The plan proposes removing 739 significant inches of qualifying trees, which <br />leaves 149” that must be mitigated. No credit is to be given for preserving “previous owner <br />planted” significant inches. <br />o In order to determine the number and type of mitigation trees required, the applicant must create <br />a table that breaks out the significant common, coniferous/evergreen, and hardwood deciduous <br />trees planned to be removed, per 105.12.470 (c) (8). Any inches removed over the allowed 30% will <br />need to be replaced at the following percentages: common tree species will need to be replaced at <br />25% of the inches removed and evergreen/hardwood trees need to be replaced at 50% of the <br />inches removed.
