The Agreement includes provisions addressing requirements for City contractors involved in any <br />portion the project construction, including minimum requirements for insurance, contractor’s right- <br />of-entry agreement, and UPRR notification and coordination. <br />6. The City must pay an annual perpetual maintenance fee to the Union Pacific Railroad in the amount <br />of $11,408 for the At-Grade Crossing Signal System. <br />7. The City must pay an annual perpetual maintenance fee to the Union Pacific Railroad in the amount <br />of $3,322 for the surface maintenance between track tie ends. <br /> <br />FISCAL IMPACT: The Total Estimated Project Cost is $1,418,000, including $1,065,200 for the At- <br />Grade Roadway Crossing and $352,800 for the Trunk Watermain Crossing. The City would also be required <br />to pay annual maintenance fees to the Union Pacific Railroad in the amount of $14,730. The Finance <br />Director will determine funding sources for the project at a later date. Street projects are paid for with levy- <br />funded debt or cash. Water projects are paid for with enterprise-funded debt or cash. A portion of the <br />improvements would be offset by “Railroad Crossing Improvement” fees collected from adjacent <br />developments. <br /> <br />RECOMMENDATION: Staff is recommending that the City Council approve, as part of the consent <br />agenda, the Union Pacific Railroad Public Highway At-Grade Crossing Agreement, Project No. 0787250, <br />for the Village Parkway UPRR Crossing Improvements.
