6 <br />VI. Practical Difficulties: <br /> <br />A variance to the provision of this chapter may be granted by the Board of Adjustment <br />upon the application by the owner of the affected property where the strict <br />enforcement of this chapter would cause practical difficulties because of circumstances <br />unique to the individual property under consideration and then only when it is <br />demonstrated that such actions will be in keeping with the spirit and intent of this <br />chapter. <br /> <br />This inquiry is easily met here. This lot was approved for subdivision by the city, it is <br />large but has some submerged lands, it is practically difficult to place a house upon the <br />land without setback issues and the lot shape and topography create similar difficulties. <br /> <br />Both the City and the applicant have an interest in curing the existence of a substandard <br />lot developed without road frontage years ago and the lot meets the basic and general <br />inquiries of the Practical Difficulties standards. <br /> <br />VII. Unique Circumstances: <br /> <br />The plight of the landowner must be due to circumstances unique to the property not <br />created by the landowner. <br /> <br />As noted above, this criteria is easily met.
