The VBWD recognizes that the proposed development’s management of stormwater runoff <br />for volume and rate control includes an assumption that 5.4 acres of new impervious surface <br />area will be created with a reconstructed Stillwater Boulevard (CSAH 14)-Lake Elmo Avenue <br />(CSAH 17) intersection adjacent to the site. The VBWD will allow the excess capacity to be <br />used for the future intersection reconstruction project, as approved by Washington County, <br />the City of Lake Elmo, and VBWD. <br />10. The applicant must obtain any necessary approvals from other persons and/or entities with <br />ownership interests in the property affected by the proposed project. It is the applicant’s <br />burden to obtain any and all necessary permissions or ownership rights to property not <br />owned by the applicant, including prescriptive easements. The applicant must obtain any <br />necessary permits. <br />11. This permit is not transferable. <br />12. The applicant agrees to indemnify and hold harmless the VBWD for any and all future liability, <br />causes of action, or claims relating to or arising out of the District’s grant of this permit. Such <br />claims include, but are not limited to, onsite flooding and flooding to neighboring properties. <br />13. This permit is subject to obtaining all other permits required by governmental agencies having <br />jurisdiction (including an NPDES permit). <br />14. The VBWD Engineer and Inspector shall be notified at least 3 days prior to commencement of <br />work. <br />15. Erosion controls shall be installed prior to the commencement of grading operations and must <br />be maintained throughout the construction period until turf is established. Additional erosion <br />controls may be required, as directed by the VBWD Inspector or VBWD Engineer. <br />16. All disturbed areas shall be vegetated within 7 days of final grading. <br />17. The applicant is responsible for removal of all temporary erosion-control measures, including <br />silt fence, upon establishment of permanent vegetation at the project site, as determined by <br />the VBWD Engineer and/or Inspector. <br />18. Valley Branch Watershed District shall be granted drainage easements that cover land <br />adjacent to stormwater management facilities, wetlands, lakes, and lowlands up to their 100- <br />year flood elevations and all ditches, storm sewers, and maintenance access to the <br />stormwater management facilities. Valley Branch Watershed District shall also be granted <br />drainage easements that cover all land used for stormwater management to meet the <br />District’s rules; this includes land irrigated by stormwater, unless the VBWD Attorney <br />approves another mechanism (e.g., Declaration of Covenants) for preserving land irrigated by <br />stormwater. If the VBWD Attorney approves a mechanism other than drainage easements for <br />preserving land irrigated by stormwater, the Managers shall approve of the mechanism prior <br />to execution. <br />19. The required drainage easements and access easements shall be recorded with the <br />Washington County Recorder’s Office.
