Highway and Slope Easement in favor of Washington County filed April 29, 1963, <br />in Book 256 of Deeds, page 159-160, as Document Number 228200. The slope <br />easement granted is as necessary for construction of the County Road No. 70. The <br />surveyor should indicate to which roadway the highway easement refers so that the <br />City may review. <br />4. Property taxes and assessments. All real estate taxes, including delinquent taxes must be <br />paid prior to recording the Plat. All assessments must also be paid prior to recording the <br />Plat. <br /> <br />PID No. 26.029.21.44.0001 <br />Taxes payable in 2024 are in the amount of $1,626.00 and are paid. Washington County <br />property tax records do not show special assessments levied against the Property. <br /> <br />There are no pending assessments. <br />5. Compliance with Minnesota Statutes Section 505.03, subdivision 2(b). Minnesota law <br />requires any preliminary plat abutting upon state railway, trunk or county highways to be <br />submitted to the Commissioner of Transportation or County Engineer for opportunity to <br />provide comments and recommendations. According to the Plat, the Property abuts County <br />State Aid Highway Nos. 10 and 17. As such, the Plat should be submitted, if it has not <br />been already, to the county highway engineer for review and an opportunity to provide <br />written comments. <br />This letter does not purport to set forth every matter relevant to a determination of whether title to <br />the Property is marketable, and no one should rely upon it for that purpose. The sole purpose of <br />this letter is to identify required signatories to the Plat and related issues of interest to the City in <br />connection with platting, as evidenced by the updated Title Commitment. <br /> <br />This opinion is conditioned upon the issuance of a title policy in the amount of $100,000 in favor <br />of the City of Lake Elmo, insuring the City’s interests as they appear on the Plat. <br /> <br />Please contact me if you have any questions regarding this information.
