Mr. Nathan Fuerst
December 20, 2024
Page 3

LA515\147\993880.v2
d. Highway and Slope Easement in favor of Washington County filed April 29, 1963,
in Book 256 of Deeds, page 159-160, as Document Number 228200. The slope
easement granted is as necessary for construction of the County Road No. 70. The
surveyor should indicate to which roadway the highway easement refers so that the
City may review.
4. Property taxes and assessments. All real estate taxes, including delinquent taxes must be
paid prior to recording the Plat. All assessments must also be paid prior to recording the
Plat.

PID No. 26.029.21.44.0001
Taxes payable in 2024 are in the amount of $1,626.00 and are paid. Washington County
property tax records do not show special assessments levied against the Property.

There are no pending assessments.
5. Compliance with Minnesota Statutes Section 505.03, subdivision 2(b). Minnesota law
requires any preliminary plat abutting upon state railway, trunk or county highways to be
submitted to the Commissioner of Transportation or County Engineer for opportunity to
provide comments and recommendations. According to the Plat, the Property abuts County
State Aid Highway Nos. 10 and 17. As such, the Plat should be submitted, if it has not
been already, to the county highway engineer for review and an opportunity to provide
written comments.
This letter does not purport to set forth every matter relevant to a determination of whether title to
the Property is marketable, and no one should rely upon it for that purpose. The sole purpose of
this letter is to identify required signatories to the Plat and related issues of interest to the City in
connection with platting, as evidenced by the updated Title Commitment.

This opinion is conditioned upon the issuance of a title policy in the amount of $100,000 in favor
of the City of Lake Elmo, insuring the City’s interests as they appear on the Plat.

Please contact me if you have any questions regarding this information. Thank you.

Sincerely,

Samantha C. Zuehlke

Samantha C. Zuehlke
