I <br />require review of these instruments prior to the City’s release of the Plat for <br />recording. <br />*Note: The Title Commitment improperly refers to the fee owner as a municipal <br />corporation. No change to the Plat in this respect is required. <br />b. The Commitment indicates that there is no mortgage on the Property. If the <br />Property is to be encumbered by a mortgage prior to the recording of the Plat, <br />either a consent to plat must be executed by the mortgagee or the mortgagee must <br />sign the Plat. I require review of any consents to plat. <br />2. Plat Corrections: <br /> <br />a. The Plat includes two approval certificates for the City Planning Commission. The <br />City Planning Commission no longer needs to approve or sign the Plat. Both <br />approval certificates for the City Planning Commission may be removed. <br /> <br />b. The governing body approval certificate is repeated on the Plat. The duplicate <br />governing body approval certificate should be removed. <br /> <br />c. The second signature line for the Washington County surveyor could be moved in <br />line with the other signature lines on the Plat, however no action is necessary. <br /> <br />3. Title Commitment Exceptions. The Plat is subject to the following exceptions: <br />a. Easement for utility purposes in favor of American Telephone and Telegraph <br />Company of Minnesota filed August 6, 1931, in Book 118 of Deeds, page 551, as <br />Document No. 101676; Easement filed April 25, 1939 in Book 135 of Deeds, page <br />373-374 as Document Number 118648; Assignment of Communication System <br />Easements and Rights-of-Way filed September 25, 1984 as Document Number <br />471911; Quit Claim Deed conveyance to Northwestern Bell Telephone Company <br />d/b/a US West Communications filed October 2, 1989 as Document Number <br />611259; Definition of Easement filed August, 1990 as Document Number 639079; <br />Corrective Definition of Easements filed April 28, 1994, as Document Number <br />797893. The surveyor should provide the location of the utility easement as defined <br />by Document Number 797893 so that the City may review. <br />b. Highway Easement in favor of Washington County dated March 23, 1961, filed in <br />Book 245 of Deeds, page 271, as Document Number 219558. The surveyor should <br />provide the location of the highway easement so that the City may review. <br />c. Slope Easement filed January 25, 1962, in Book 245 of Deeds, page 272. The <br />surveyor should provide the location of Washington County’s slope easement along <br />C.S.A.H. 17 for the City’s review.
