<br /> <br />LA515-1-859180.v2 3 <br /> <br />Any bidder may be required, as a condition to award of the contract to the bidder, to furnish <br />additional evidence that the bidder and its proposed subcontractors have sufficient <br />experience to ensure completion of the work in a satisfactory manner, and have <br />successfully supplied products and/or performed work similar in scope and type to the <br />products and/or work for which the bidder has bid. <br /> <br />4. Bid Form Submittal. <br /> <br />Two copies of the bid form together with bid security and any additional information, must <br />be submitted in a sealed envelope with the name of the bidder, its address and the statement <br />“Tablyn and Pebble Courts” clearly indicated. All bids must be mailed or personally <br />delivered to Adam Swanepoel: 3880 Laverne Ave. Lake Elmo, MN 55042. The bid must <br />be received no later than 12:30 p.m. on March 31, 2023. Late bids will not be accepted. <br />It shall be the responsibility of the bidder to assure that its bid arrives on time. The City <br />shall have no responsibility or liability to any bidder whose bid is not received by the <br />deadline, regardless of whether a delay is caused by a third party, the United States Postal <br />Service, or failure or unavailability of any transmitting device or service. <br /> <br />5. Completion. <br /> <br />The successful bidder shall complete and install the Tablyn and Pebble Courts by October <br />15, 2023. Liquidated damages of $100 per week will be assessed by the City in the event <br />that the courts are not installed and accepted by the City by this date. <br /> <br />6. Questions. <br /> <br />Questions by bidders concerning the project shall be submitted in writing to: <br /> <br />Adam Swanepoel <br />3880 Laverne Ave. N <br />Lake Elmo, MN 55042 <br />aswanepoel@lakeelmo.org <br /> <br />7. Bid Modifications or Withdrawal. <br /> <br />Modifications of a bid must be submitted to the City in writing by an authorized partner or <br />officer (as the case may be) of the bidder on the bidder’s letterhead and must specify which <br />components of the bid are being modified. Modifications must be received by the City by <br />mail, personal delivery and marked to the attention of Adam Swanepoel, prior to the time <br />scheduled for the opening of bids. Telephone or oral modifications will not be accepted. <br /> <br />Bids may be withdrawn in writing by an authorized partner or officer (as the case may be) <br />of the bidder on the bidder’s letterhead received by the City by mail, personal delivery and <br />marked to the attention of the Adam Swanepoel, prior to the time scheduled for opening <br />of bids. <br />
