<br />LA515-110-838683.v10 <br />5. DEVELOPMENT PLANS. The Developer agrees to develop the Subdivision in <br />accordance with the City approvals, including the terms and conditions of approval of the final plat <br />as detailed in City Council Resolution No. XXX, to construct all improvements in accordance with <br />the approved construction plans and specifications (collectively, the “Plans”) prepared by a <br />professional engineer licensed in the State of Minnesota at its sole expense. All terms and <br />conditions of the City approvals are hereby incorporated by reference into this Agreement. The <br />documents which constitute the Plans are those on file with and approved by the City and are <br />listed on Exhibit B attached hereto. The Plans may not be modified by the Developer without <br />the prior written approval of the City. <br />6. IMPROVEMENTS. In developing the Subdivision in accordance with the Plans, the <br />Developer shall make or install at its sole expense, the following public and private improvements <br />(collectively, the “Subdivision Improvements”): <br />A. Grading and erosion control; <br />B. Sanitary sewer; <br />C. Water system improvements; <br />D. Stormwater improvements (storm sewer pipe, control structures, ponds, BMPs, <br />etc.) <br />E. Hudson Boulevard street improvements; <br />F. Julia Avenue street improvements; <br />G. Trails; <br />H. Underground private utilities; <br />I. Landscaping; <br />J. Street lighting and signage; <br />K. Tree preservation and reforestation; <br />L. Emergency vehicle access; and <br />M. Monuments required by Minnesota Statutes. <br /> All improvements shall be installed in accordance with the approved Plans, the City <br />approvals, the City Code, the City’s Engineering Design and Construction Standards Manual, and <br />the City’s Landscape and Irrigation Standards.
