City Council Meeting <br />March 21, 2023 Page 10 <br /> <br /> <br />Staff asked that the dissenting Planning Commissioners provide findings to the City Council for <br />denial. Those findings are summarized by staff below: <br />• The Developer did not provide reasonable solutions to issues raised through public <br />comments. Those issues were specifically landscaping and tree preservation. <br />• The deviations requested by the Developer were not supported. <br /> <br />RECOMMENDATION: <br />Staff have reviewed the findings of fact provided by the Planning Commissioners in favor of <br />denial and offer the following comments: <br />• A requirement for regional ponding between two private developments is both <br />impractical and inadvisable at this time. Staff and both of the surrounding developers do <br />not have enough information to verify that the stormwater from the proposed Wildflower <br />Twinhomes development could be accommodated on the Wildflower at Lake Elmo site. <br />Regional ponding would still be required to meet Valley Branch Watershed District rules <br />and may require more land area or other improvements that cannot be identified yet at <br />this time. <br /> <br />Staff also find that, at this point in the development process, requiring regional ponding <br />would not be advisable. Such a requirement would go above and beyond any zoning or <br />engineering standards and necessitate an agreement between two private properties. Such <br />a requirement was not anticipated or planned for in any of the City’s guiding planning <br />documents. <br /> <br />• Staff find that the development meets the minimum requirements for a PUD. Staff have <br />also identified several ways in which the City could find that this development meets the <br />Identified Objectives for PUD projects. The City Council should review staff’s findings <br />in this area to make a determination of whether a PUD is warranted, and if so, which <br />deviations are acceptable. <br /> <br />Based on the above analysis of the proposed development, City staff find the proposal to be <br />generally in line with the City’s adopted ordinances and policies. Staff is therefore <br />recommending the City Council take the following action for the proposed project at PID <br />13.029.21.21.0009: <br /> <br /> <br />Preliminary PUD/Preliminary Plat <br />Should the City Council agree with staff’s recommendations and findings, it should approve the <br />proposed preliminary PUD plan and preliminary plat for the subject property with the <br />recommended findings and conditions of approval listed in the staff report. <br /> <br />“Motion to adopt Resolution 2023-024 approving the preliminary plat and PUD requested by <br />Landucci Construction, Inc. for the subject property based on the findings of fact and <br />recommended conditions of approval listed in the staff report.” <br /> <br /> <br /> <br />
