The <br />Agreement shall outline any approved phasing plan. <br />15. The applicant or developer shall enter into a separate grading agreement with the City <br />before starting any grading activity in advance of final plat/ PUD approval. The City <br />Engineer shall review any grading plan that is submitted in advance of a final plat or final <br />PUD, and said plan shall document the extent of any proposed grading on the site. <br /> <br />FISCAL IMPACT: Approval of a Preliminary Plat and Preliminary PUD grant entitlements to a <br />developer. Therefore, there would be no fiscal impact to the City at this time. When the property <br />begins to develop it will have urban services and will pay sewer and water connection charges, <br />building permit fees and the like. <br /> <br />PUBLIC COMMENT: <br />A public hearing was noticed and held at the Planning Commission meeting on February 17, <br />2023. City staff received a number public comments from residents and representatives of those <br />in the area of the development. Written public comments received on this item are attached to <br />this report. <br /> <br />Four residents provided public comments during the Planning Commission meeting. Comments <br />from the public on this development are generally summarized by staff below: <br />• Development name – residents took issue with the similarity of the name “Wildflower <br />Twinhomes” due to a potential for confusion of the development to the North, <br />“Wildflower at Lake Elmo”. <br />• Landscaping and tree removal – residents of surrounding properties objected to the tree <br />removals that would be required for the mass grading of this development, and <br />stormwater pond. It was suggested at the Planning Commission meeting that this <br />developer coordinate with the developer of Wildflower at Lake Elmo to the north to <br />consolidate stormwater ponds and save or replant the trees along the northern property <br />line of the subject property. <br />• Other comments related to the aesthetic impact of this development, the sidewalk <br />connection, and noise impacts of the pickle ball court amenity. <br /> <br />OPTIONS: <br />The City Council may: <br />• Approve the requests. <br />• Approve the requests with conditions. <br />• Deny the requests, citing findings of fact. <br /> <br />PLANNING COMMISSION RECOMMENDATION: <br />The Planning Commission reviewed the request, heard public comments, and discussed the <br />proposed development at their regular meeting on February 17, 2023. A motion was made to <br />recommend approval of this item, with the findings proposed by staff and an additional condition <br />of approval. That motion failed for lack of majority on a 2-2 vote. <br />
