<br />2 <br />LA515\1\1001336.v1 <br /> <br /> <br />Code Section: 105.12.210 Setbacks The intent of this amendment is to clarify setback distances in <br />cases where property lines cross public streets. <br /> <br />Proposed Language:. <br />(a) Front setbacks. Where adjacent residential structures on the same side of the street <br />between intersections have front yard setbacks different from those required, the front yard <br />minimum setback shall be the average of the immediately adjacent structures. If there is <br />only one immediately adjacent structure, the front yard minimum setback shall be the <br />average of the required setback and the setback of the adjacent structure. In no case shall <br />the required front yard setback exceed the required minimum established within the <br />districts of this chapter. <br />(b) Side and rear setbacks. Subject to regulations contained in the building code and other <br />applicable regulations, side and rear setback requirements may be waived, provided party <br />walls are used and the adjacent buildings are constructed as an integral unit and are part of <br />an approved shopping center, townhouse development, or other similar development. The <br />waiver shall only be by issuance of a variance. <br />(c) Setbacks from private roads. All setback requirements of this chapter shall also be <br />applicable to private roads and easement access rights-of-way. <br />(d) Setbacks from roads. Where property lines extend across public roads, the setbacks shall <br />be measured from the adjacent right-of-way. <br /> <br />Code Section: 105.12.400(b) Fencing Regulations The intent of this amendment is to permit <br />temporary fences where necessary to provide adequate space for construction activities, safety, <br />and to meet SWPPP and NPDES permit requirements. <br /> <br />Proposed Language: <br />(b) Definitions. The following words, terms and phrases, when used in this section, shall have the <br />meaning ascribed to them in this subsection, except where the context clearly indicates a different <br />meaning: <br /> <br />Permanent fence means fences that are installed in a fixed or enduring manner that are not <br />intended for a seasonal or temporary purpose. <br /> <br />Temporary fence means fences that are installed and removed on a seasonal basis, such as snow <br />fences, garden fences and seasonal recreational fences, such as hockey boards. Temporary fences <br />do not include construction or silt fencing approved by the city. <br />
