2 <br /> <br />REVIEW AND ANALYSIS: <br />Minor Subdivision: The City’s subdivision regulations allow for certain major subdivision procedures and <br />requirements to be waived when certain criteria are met. The minor subdivision process allows for <br />concurrent review and approval of a preliminary and final plat. Below is a review of the minor <br />subdivision criteria: <br />1. The proposed minor subdivision will result in no more than four parcels. Nine parcels will <br />become two parcels. <br />2. The proposed minor subdivision will not require any new infrastructure or streets. Existing <br />right-of-way will be dedicated to clean up the area. <br />3. Easements have been dedicated where applicable. <br />4. This request will meet the City’s Village Mixed Use (VMX) zoning lot dimension and bulk <br />building requirements. <br />5. The request will meet the City of Lake Elmo’s access spacing and location. No new <br />driveways or access points are proposed with this request. <br /> <br />CITY AGENCY REVIEW: <br />The following departments provided comments: <br />• Public Works (Email 1.6.2026) – No comment <br />• Valley Branch Watershed District - VBWD permit required and was submitted on 1.9.2026 and <br />approved on 1.22.2027 <br />• City Engineer (Email 1.12.2026) - Provided comments recommending minor adjustments to ROW <br />and easement areas. They have since been incorporated. <br />• Fire Department (Email 1.6.2025) – No comments <br />• City Attorney – Provided a plat opinion with requested revisions. A condition of approval has <br />been added regarding this memo. <br />• MN DNR – No comment <br /> <br />PUBLIC COMMENT: <br />A public hearing notice was sent to surrounding properties on January 26, 2026 A public hearing notice <br />was published in the City’s official newspaper on January 30, 2026. Staff has not received any public <br />comment at this time. <br /> <br />FINDINGS: <br />Staff is recommending that the Planning Commission consider the following findings with regards to <br />the requests: <br />• That the Lake Elmo Firehouse Addition minor subdivision is consistent with the <br />Lake Elmo Comprehensive Plan and the Future Land Use Map for this area. <br />• That the Lake Elmo Firehouse Addition minor subdivision is consistent with the future <br />development plans of the area and with the standards of the City’s village mixed use zoning <br />district. <br />• That the Lake Elmo Firehouse Addition minor subdivision meets the requirements of the <br />City’s minor subdivision regulations. <br /> <br />RECOMMENDED CONDITIONS OF APPROVAL: <br />1. The applicant must obtain all other necessary City, state, and other governing body permits <br />and approvals prior to release of the plat for recording. <br />2. The City Attorney’s comments set forth in the plat opinion shall be addressed prior to <br />release of the plat for recording.
