CITY OF LAKE ELMO <br />COUNTY OF WASHINGTON <br />STATE OF MINNESOTA <br />ORDINANCE NO. 2026-02 <br />AN ORDINANCE AMENDING THE LAKE ELMO CITY CODE FOR PUBLIC WORKS, <br /> ZONING AND LAND USE SECTIONS <br />SECTION 1. The City Council of the City of Lake Elmo hereby amends Title 5 Public Works; <br />Chapter 5.12: Solid Waste, Section 080 Container Required; Placement is hereby amended by <br />changing the following section (Proposed language is underlined; deleted language is shown with <br />strikethrough): <br />(d) All garbage, recycling and refuse containers shall be placed as follows in residential areas: <br />(1) Except for collection day, all containers shall be kept behind the front setback line of the dwelling, in <br />the garage, or otherwise screened from view from the street and at least ten feet from any abutting <br />dwelling. <br />(2) On collection day, except where vat or in-yard service is required, containers shall be placed at the <br />curb, in a location easily accessible for motor vehicle pick-up. Containers must be placed for pick-up <br />before 7:00 a.m. 6:00 a.m. on the day of collection to ensure service. The hauler shall complete pick- <br />ups by 7:00 p.m., unless emergency permission is granted by the city, and all containers must be <br />removed from the curb no later than 8:00 p.m. on collection day. <br />SECTION 2. The City Council of the City of Lake Elmo hereby amends Title 105 Zoning; Chapter <br />105.12: Zoning Code, Section 210 Setbacks is hereby amended by changing the following section <br />(Proposed language is underlined, deleted language is shown with strikethrough): <br />(a)Front setbacks. Where adjacent residential structures on the same side of the street between intersections <br />have front yard setbacks different from those required, the front yard minimum setback shall be the <br />average of the immediately adjacent structures. If there is only one immediately adjacent structure, the <br />front yard minimum setback shall be the average of the required setback and the setback of the adjacent <br />structure. In no case shall the required front yard setback exceed the required minimum established <br />within the districts of this chapter. <br />(b)Side and rear setbacks. Subject to regulations contained in the building code and other applicable <br />regulations, side and rear setback requirements may be waived, provided party walls are used and the <br />adjacent buildings are constructed as an integral unit and are part of an approved shopping center, <br />townhouse development, or other similar development. The waiver shall only be by issuance of a <br />variance. <br />(c)Setbacks from private roads. All setback requirements of this chapter shall also be applicable to private <br />roads and easement access rights-of-way. <br />(d)Setbacks from roads. Where property lines extend across public roads, the setbacks shall be measured <br />from the adjacent right-of-way.
