SECTION 3. The City Council of the City of Lake Elmo hereby amends Title 105 Zoning; Chapter <br />105.12: Zoning Code, Section 400 Fencing Regulations is hereby amended by changing the following <br />section (Proposed language is underlined, deleted language is shown with strikethrough): <br />(b) Definitions. The following words, terms and phrases, when used in this section, shall have the meaning <br />ascribed to them in this subsection, except where the context clearly indicates a different meaning: <br />Permanent fence means fences that are installed in a fixed or enduring manner that are not intended for a <br />seasonal or temporary purpose. <br />Temporary fence means fences that are installed and removed on a seasonal basis, such as snow fences, <br />garden fences and seasonal recreational fences, such as hockey boards. Temporary fences do not include <br />construction or silt fencing approved by the city. <br />SECTION 4. The City Council of the City of Lake Elmo hereby amends Title 105 Zoning; Chapter <br />105.12: Zoning Code, Section 920 Permitted, Conditional And Interim Uses is hereby amended by <br />changing the following section (Proposed language is underlined, deleted language is shown with <br />strikethrough): <br />Table 12-1: Permitted, Conditional and Interim Uses, Commercial Districts <br />LC CC C BP Standard <br />Residential Uses: <br />Household Living: <br />Single-family attached dwelling --C --LEC 105.12.950(a) <br />Multifamily dwelling --C --LEC 105.12.950(b) <br />Live-work unit C C C --LEC 105.12.110(b)(1) <br />Group Living: <br />Semi-transient accommodations --C --LEC 105.12.500(d) <br />Congregate housing --C --LEC 105.12.500(c) <br />SECTION 5. The City Council of the City of Lake Elmo hereby amends Title 105 Zoning; Chapter <br />105.12: Zoning Code, Section 960 Commercial District Design Standards is hereby amended by <br />changing the following section (Proposed language is underlined, deleted language is shown with <br />strikethrough): <br />Review of design. For certain development activity as specified in the Lake Elmo Design Guidelines and <br />Standards Manual, design review is required as part of the approval process for a permit or certificate under <br />this section. All projects subject to design review shall be reviewed for conformance with the Lake Elmo <br />Design Guidelines and Standards Manual and shall follow the review procedures specified in LEC <br />105.12.830.840. <br />SECTION 6. Effective Date. This ordinance shall become effective immediately upon adoption and <br />publication in the official newspaper of the City of Lake Elmo. <br />SECTION 7. Adoption Date. This Ordinance 2026-02 was adopted on this 17th day of February 2026, by a <br />vote of __ Ayes and ___Nays.
